Terms of service

1. The service

Widgev (“the service”) lets you create, host and embed widgets on websites you control, collects the responses those widgets receive, and sorts and routes them according to your settings. The service is provided by [Your company legal name] (“we”).

2. Your account

You may use the service without creating a full account. You are responsible for anything done through your account and for keeping your access secure. You must be at least 16 and able to enter a contract. If you use the service for a business, you confirm you are allowed to bind it.

3. Your content and your visitors' data

You own the widgets you build and the responses they collect. You grant us the licence needed to host, display, process and back up that content so we can provide the service. You are the data controller for responses from your visitors; we process them on your behalf under our privacy policy, which forms part of these terms as our data processing terms. You must have a lawful basis to collect what your widgets ask for and must show your own privacy notice where the law requires it.

4. Acceptable use

You must not use the service to:

• collect passwords, payment card numbers, government identifiers, health data or other sensitive data unless you have a lawful basis and tell your visitors;
• send spam, phish, mislead visitors about who is collecting their data, or impersonate another business;
• embed widgets on sites you do not control or in violation of that site's rules;
• attack, overload or probe the service, or interfere with other customers;
• break the law or infringe someone else's rights.

We may remove content or suspend accounts that break these rules. We will tell you why unless the law prevents it.

5. Plans, payment and changes

Free plans have the limits shown on the pricing page. Paid plans are billed in advance, monthly or yearly, through our payment provider. Prices exclude taxes. If you exceed your plan's response limit we will tell you and suggest a higher plan; widgets keep working. We may change prices with at least 30 days' notice; changes apply from your next billing period. Refunds are described in our refund policy.

6. Automated sorting

Response sorting, spam filtering and rule execution are automated and will sometimes be wrong. They are aids, not decisions. You remain responsible for how you act on responses, and you should not use sorting outcomes to make decisions with legal or similarly significant effects on a person.

7. Availability

We aim for the service to be available at all times, but it is provided “as is” and “as available”. We may change or discontinue features with reasonable notice. Planned maintenance will be announced in advance where practical.

8. Intellectual property

The service, its design and its software belong to us. You may not copy, resell or reverse engineer it. Feedback you send us may be used without obligation.

9. Termination

You can stop using the service or delete your account at any time. We can terminate accounts that breach these terms or after prolonged inactivity on a free plan (see the privacy policy for retention). On termination your widgets stop working and your data is deleted after the retention period. Export your responses before you leave.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You will cover us for claims arising from your content, your widgets, or your breach of these terms.

12. General

These terms are governed by the laws of [Country], and its courts have jurisdiction. If part of these terms is unenforceable, the rest still applies. These terms, the privacy policy and the refund policy are the whole agreement between us. We may update these terms; material changes will be emailed to customers and take effect 30 days after notice.
